Couple claims State Farm breached contract

ST. LOUIS – A couple is seeking underinsured motorist benefits from their insurer.

Madonna Tierney and Ronald Tierney filed a complaint on May 15 in the St. Louis Circuit Court against State Farm Mutual Automobile Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on June 23, 2017, Madonna Tierney was injured in an automobile accident due to the negligence of Jacqueline Asinger, an underinsured motorist. She alleges she suffered injuries and damages in excess of the at-fault driver's policy limits. 

The plaintiffs seek damages in an amount greater than $25,000, plus costs of this action and any further relief as the court may deem proper and just. They are represented by Thomas E. Schwartz of Holloran Schwartz & Gaertner LLP in St. Louis.
