Property owner seeks to halt demolition of St. Louis property

ST. LOUIS – The owner of a property and structure in St. Louis is challenging the city's permit to demolish the structure.

Cardinal Properties of St. Louis XI LC filed a motion for equitable relief on May 15 in the St. Louis Circuit Court against the city of St. Louis.

According to the complaint, the plaintiff owns a property in the city. The plaintiff alleges the defendant sent it a notice of condemnation in July 2017 and a permit was applied to demolish the structure on Jan. 30. The suit states the city's ordinance states that a building is subject to demolition after it has been ordered secured for 12 months.

The plaintiff alleges it is willing and able to bring the property up to code and that demolition is improper and in violation of the defendant's own ordinance because the structure has not been condemned for 12 months.

The plaintiff alleges it will suffer further irreparable harm unless the defendant is restrained and prevented from demolishing the property.

The plaintiff seeks an order permanently enjoining and restricting defendant from demolishing its property, plus costs of this action and any further relief that the court may deem just. It is represented by Christopher W. Basler of Davis & Travaglini LLC in St. Louis.
