Injured motorist alleges Travelers Home and Marine Insurance breached contract

ST. LOUIS – A Fenton resident alleges she is entitled to uninsured motorist coverage for injuries sustained in a collision in the state.

Ladonna Ly filed a complaint on May 14 in the St. Louis 22nd Judicial Circuit Court against Travelers Home and Marine Insurance Co., John Jones and FCNB Insurance Services Inc. alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that on May 14, 2013, her vehicle was struck by another vehicle whose driver/owner did not have liability insurance. The plaintiff alleges she was covered by a policy issued by Travelers and AAA Insurance Co. at the time of the collision. She alleges Jones, an agent of FCNB and acting on behalf of Travelers, failed to tell her that her Travelers policy had an automatic termination provision that would terminate it effective of the date of the other insurance policy.

The suit states Travelers retroactively canceled her policy on June 13, 2013, and backdated it to April 1 of the year and did not return her premium money.

The plaintiff alleges she is entitled to coverage under the uninsured motorist provision of her Traveler's policy to cover injuries she sustained in the collision.

The plaintiff holds Travelers Home and Marine Insurance Co., Jones and FCNB Insurance Services Inc. responsible because the Travelers alleged breached the agreement but not providing the plaintiff with the coverage she alleges she was promised.

The plaintiff requests a trial by jury and seeks judgment of more than $25,000 and for any and other relief as the court deems just and proper. She is represented by Gene S. Hou of Missouri Injury Law Firm LLC in High Ridge.
