Ultima Disaster Restoration alleges it is owed more than $35,000 for work on St. Louis property

ST. LOUIS – A contractor alleges it was not paid for improvements it performed on a St. Louis property.

Ultima Disaster Restoration Inc. filed a complaint on May 14 in the St. Louis Circuit Court against 1617 Third Street LLC alleging breach of contract, unjust enrichment and other counts.

According to the complaint, the plaintiff alleges that it performed improvements to enhance defendant's St. Louis property as requested. The plaintiff alleges it provided labor, supplies and services in the amount of $38,778.84 without receiving payments.

The plaintiff holds 1617 Third Street LLC responsible because despite demands for payments, the defendant failed and refused to do so.

The plaintiff seeks judgment against the defendant in the sum of $38,778.84, an order to impose a lien on defendant's property and the sale of the property to satisfy the lien, plus interest, costs and any further relief as the court deems proper and just. It is represented by Wesley T. Kozeny of Kozeny & McCubbin LC in St. Louis.
