ST. LOUIS – A driver and passenger injured in a collision with a hit-and-run driver allege their insurer presented an offer to settle their claims that was vexatious and without reasonable cause.
Lela Ford and Mya McCrary filed a complaint on June 13 in the St. Louis Circuit Court against Young America Insurance Co. alleging vexatious refusal to pay.
According to the complaint, the plaintiffs allege that on Oct. 7, 2016, they were involved in a collision caused by a hit-and-run driver. They allege they suffered injuries that required medical treatment.
The suit states Ford demands to settle her claims for $25,000 and McCrary demands to settle for $15,000. They allege the defendant offered $500 to settle each of their claims.
The plaintiffs hold Young America Insurance Co. responsible because the defendant allegedly breached its obligation to fully compensate them for their damages.
The plaintiffs seek damages of more than $25,000 for each of them, costs of this action and any further relief that are proper and just. They are represented by Jeremy A. Gogel of The Gogel Law Firm in St. Louis.
