St. Louis Loves Travel Stops & Country Stores location alleged to have supplied incorrect fuel

ST. LOUIS – A liability insurer alleges a St. Louis business supplied unleaded fuel instead of diesel and damaged a truck.

American Alternative Insurance Corp., as subrogee of Garden City Fire Protection District and Ambulance, filed a complaint on June 19, in the St. Louis Circuit Court against Loves Travel Stops & Country Stores Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 10, 2016, the Garden City Fire Protection District and Ambulance purchased and requested defendant to pump 25 gallons of diesel fuel into the tank of its truck. The suit states that instead of diesel fuel, the defendant supplied unleaded fuel, damaging the truck.

As a result of defendant's negligence, the suit states Garden City sustained serious and permanent damages to its truck's engine, loss of use and depreciation of approximately $30,000. 

The plaintiff holds Loves Travel Stops & Country Stores Inc. responsible because the defendant allegedly negligently supplied and pumped unleaded fuel, instead of the requested diesel fuel.

The plaintiff seeks damages of more than $25,000, plus costs of this action and any further relief as the court may deem just and proper. It is represented by Brian R. Plegge of Brown & James PC in St. Louis.
