Driver alleges American Family Mutual Insurance has failed to pay any amount under claim

ST. LOUIS – An insured driver is seeking damages from his insurance company and another motorist over alleged injuries sustained in a collision in St. Louis.

Steve Harter filed a complaint on July 2 in the St. Louis Circuit Court against American Family Mutual Insurance Co. and Terrence Smith alleging negligence and vexatious refusal to pay damages.

According to the complaint, the plaintiff alleges that on July 1, 2013, he was traveling north on Interstate 55 in St. Louis when defendant Smith, an uninsured driver, changed lanes and struck the vehicle in front of the plaintiff, causing a chain reaction of accidents. The plaintiff alleges he sustained a concussive brain injury as a result of the accident.

The plaintiff alleges he made a claim for uninsured motorist coverage under the policy provided by defendant American Family for a total limit of $1.2 million. 

The plaintiff holds American Family Mutual Insurance Co. and Smith responsible because Smith failed to yield to the right of way and failed to keep a careful lookout defendant American Family has failed to pay any amount under the policy.

The plaintiff seeks damages of more than $25,000, plus costs, attorney's fees and all further relief as the court may deem just and proper. He is represented by Christopher Finney of Mutrux Finney PC in St. Louis.
