Driver alleges American Family Mutual Insurance refuses to pay underinsured motorist coverage

ST. LOUIS – A St. Charles County driver alleges his insurer has failed to pay him underinsured motorist benefits after a collision in the county.

Kaise Salah filed a complaint on June 29 in the St. Louis Circuit Court against American Family Mutual Insurance Co. alleging vexatious refusal.

According to the complaint, the plaintiff alleges that on Jan. 17, 2017, he was involved in an auto collision due the carelessness of an underinsured driver at the intersection of Mid Rivers Mall and Mexico roads in St. Charles County. At the time of the accident, plaintiff alleges he was covered with underinsured motorist coverage under the policy provided by defendant. 

The plaintiff holds American Family Mutual Insurance Co. responsible because the defendant allegedly failed and refused to issue payment to him for the underinsured motorist coverage.

The plaintiff requests a trial by jury and seeks judgment in his favor ordering defendant to pay his claim in the amount of the policy coverage, award for costs, expenses and all further relief as the court may deem fair and reasonable.
