Motorcycle rider injured in accident seeks damages from driver, State Farm

ST. LOUIS – An Imperial man is seeking damages from an Illinois driver and his insurance company after an accident in St. Louis.

Anthony Foster filed a complaint on July 6 in the St. Louis 22nd Judicial Circuit Court against Ashley Eaverson, Scott Brase State Farm Agency and State Farm Insurance Co. alleging negligence and violation of the Missouri Merchandising Practices Act.

According to the complaint, the plaintiff alleges that on Nov. 1, 2015, he was driving his motorcycle on Washington Avenue near its intersection with Third Street in St. Louis when defendant Eaverson's vehicle struck the rear of his motorcycle, causing injuries.

The plaintiff alleges he had insurance through the State Farm defendants at the time of the accident and that State Farm accepted payment for the policy, but the defendants allege they sent a cancellation notice in October 2015. The plaintiff alleges he never received the notice.

The plaintiff holds Eaverson, Scott Brase State Farm Agency and State Farm Insurance Co. responsible because Eaverson failed to keep a careful lookout and defendants Brase and State Farm allegedly practiced deception and misrepresentation regarding his policy.

The plaintiff requests a trial by jury and seeks damages of no less than $25,000, attorney's fees, costs and all further relief as the court may deem just and proper. He is represented by Joel K. Halvorsen and Gregory Klote of Halvorsen Klote in St. Louis.
