ST. LOUIS – A Kansas corporation in the business of transport refrigeration products alleges it will suffer injuries if a former employee is not enjoined from using confidential information.
CSTK Inc. filed a complaint on July 24 in the St. Louis Circuit Court against Doug Myers citing the Kansas Uniform Trade Secrets Act.
According to the complaint, the plaintiff rehired the defendant in 2007 as an aftermarket sales representative. The suit states Myers signed an agreement that included provisions addressing confidential information and noncompetition.
The suit states Myers resigned in June to work for a direct competitor in breach of the agreement and that the plaintiff learned that the defendant had forwarded confidential information from his company email account to a personal email count.
The plaintiff alleges that it stands to and will continue to suffer immediate and irreparable harm for which there is no remedy if the defendant is not enjoined from engaging in conduct that is prohibited under the agreement he signed.
The plaintiff seeks preliminary and permanent injunction restraining and enjoining defendant from retaining and using plaintiff's confidential information, award for actual and punitive damages, attorney's fees, costs and any further relief as the court may deem proper and just.
