Man alleges asbestos exposure on South Dakota job sites led to lung cancer

ST. LOUIS – A former mechanic and construction worker alleges he was exposed to asbestos while on job sites in South Dakota and caused injury.

Ronald Kulm and Arzella Kulm filed a complaint on Aug. 8 in the St. Louis 22nd Judicial Circuit Court against Advance Auto Parts Inc., Gould Pumps LLC, IMO Industries Inc. et al. alleging negligence and other counts.

According to the complaint, the plaintiffs allege that at various times during Ronald Kulm's career life from the 1950s to the 1980s in South Dakota, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. The suit states that on or about Oct. 24, 2014, he first became aware that he developed lung cancer, an asbestos-induced disease, and that the disease was wrongfully caused. 

The plaintiffs hold Advance Auto Parts Inc., Gould Pumps LLC, IMO Industries Inc. et al. responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiffs seek compensatory damages of more than $50,000, plus costs, interest and any further relief as the court deems just and equitable. They are represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
