ST. LOUIS – A widow and adult children allege their decedent's death from mesothelioma was wrongfully caused by asbestos exposure.
Norma Cutler, et al., surviving heirs of William D. Cutler, deceased filed a complaint on Aug. 7 in the St. Louis 22nd Judicial Circuit Court against General Gasket Corp. and Murphy Co. Mechanical Contractors and Engineers alleging strict liability, negligence and other counts.
According to the complaint, the plaintiffs allege that during the course of William Cutler's employment, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. As a result he developed mesothelioma, an asbestos-induced disease, and died on Dec. 17, 2015.
The plaintiffs hold General Gasket Corp. and Murphy Co. Mechanical Contractors and Engineers responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
The plaintiffs seek actual and compensatory damages, and all further relief as the court may deem just and equitable. They are represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
