Pedestrian alleges St. Louis failed to fill hole after tree stump removal

ST. LOUIS – A St. Louis resident alleges that the city failed to fill a hole left by the removal of a tree stump near her house and that the hole caused her injuries.

Bernice Evans filed a complaint on Aug. 15 in the St. Louis Circuit Court against the city of St. Louis alleging negligence.

According to the complaint, the plaintiff alleges that on Aug. 15, 2013, she exited her home at 5632 Chamberlain Ave. As she crossed the easement between the sidewalk and the street, she stepped into an unfilled hole from a removed tree stump. She alleges sustained injuries to her neck, back, right shoulder, rights foot and right leg and incurred medical expenses of more than $17,000 as a result of the incident. 

The plaintiff holds the city of St. Louis responsible because the defendant allegedly failed to fill the hole left by the removal of the tree stump and failed to post warnings.

The plaintiff requests a trial by jury and seeks damages of more than $25,000, plus costs and any further relief as the court deems just and proper. She is represented by Cecil L. Skaggs of Central West End Law Office in St. Louis.
