Individuals allege Garrison Property and Casualty failed to pay claim over collision with stolen vehicle

ST. LOUIS – A mother and minor child allege they were injured in a collision involving a stolen car and that their insurer refused to pay their claim.

Andrea Williams and Aiden Williams, a minor, by and through his natural parent and next friend Andrea Williams, filed a complaint on Aug. 15 in the St. Louis Circuit Court against Garrison Property and Casualty Insurance Co. alleging vexatious refusal.

According to the complaint, the plaintiffs allege that on Sept. 29, 2016, while the insurance policy issued by defendant was in full force and effect, they were involved in an automobile collision due to the negligence of a driver operating an uninsured, stolen vehicle. They allege they sustained bodily injuries and incurred medical expenses of more than $25,000 for each of them as a result of the collision. 

The plaintiffs holds Garrison Property and Casualty Insurance Co. responsible because the defendant allegedly failed to refused to pay plaintiffs' claim for uninsured motorist coverage.

The plaintiffs seek payment in the amount of the uninsured motorist coverage of the policy, plus costs, expenses, attorney's fees and all further relief as the court may deem just and proper. They are represented by Allison F. Stenger and John C. Burns of Klar, Izsak & Stenger LLC in St. Louis.
