Widow files suit against Flowserve, others over husband's cancer death

ST. LOUIS – A widow alleges her husband developed lung cancer as a result of exposure to asbestos during his employment.

Claralene Duvall, individually and as surviving heir of the estate of David Duvall, deceased filed a complaint on Aug. 8 in the St. Louis 22nd Judicial Circuit Court against CBS Corp., Flowserve US Inc., Gardner Denver Inc. et al. alleging negligence.

According to the complaint, the plaintiff alleges that at various times during David Duvall's career and military life, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. The suit states that on or about Nov. 29, 2015, decedent first became aware that he developed lung cancer, an asbestos-induced disease, and that the disease was wrongfully caused. He died on April 27, the suit states. 

The plaintiff holds CBS Corp., Flowserve US Inc., Gardner Denver Inc., et al. responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks compensatory damages of more than $50,000, plus interest, costs and any further relief as the court may deem just and equitable. She is represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
