Couple seeks damages from Borg-Warner, others over alleged asbestos-related injuries

ST. LOUIS – A man alleges exposure to asbestos at various job sites in Georgia caused him to develop lung cancer.

Anthony Winters and Deborah Winters filed a complaint on Aug. 22 in the St. Louis 22nd Judicial Circuit Court against Borg-Warner Corp., Gardner Denver Inc., ITT Corp., et al. alleging negligence and strict liability.

According to the complaint, the plaintiffs allege that at various times during Anthony Winters' career life in Georgia, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. He alleges that on or about Feb. 27, he first became aware that he developed lung cancer, an asbestos-induced disease, and that the disease was wrongfully caused. 

The plaintiffs hold Borg-Warner Corp., Gardner Denver Inc., ITT Corp., et al. responsible because the defendants allegedly intentionally included asbestos fibers in their products when they knew that it had toxic, poisonous and highly deleterious effect to human health and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiffs seek actual and compensatory damages of more than $50,000, plus costs, interest and all further relief as the court may deem just and equitable. They are represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
