Medical malpractice suit filed against Aviary Recovery Center, Summit BHC Saint Louis

ST. LOUIS – A former patient and parents of a substance abuse treatment facility alleges it deceptively marketed itself as having expertise to treat dual diagnosis.

Daniel Kuc, Bill Kuc and Mary Kuc filed a complaint on Aug. 24 in the St. Louis 22nd Judicial Circuit Court against Summit BHC Saint Louis LLC, The Aviary Recovery Center, et al. citing the Missouri Merchandising Practices Act, medical malpractice and other counts.

According to the complaint, the plaintiffs allege that in 2017, Daniel Kuc was under the care of the defendants for treatment of bipolar disorder and substance abuse disorder. The suit states the defendants took his prescription medications from him and that their plan for him was not created by any person with expertise in dual diagnosis mental health treatment. The suit states Daniel Kuc went through withdrawal while at the defendant's facility.

The plaintiffs hold Summit BHC Saint Louis LLC, The Aviary Recovery Center, et al. responsible because the defendants allegedly falsely represented that they had the expertise to treat dual diagnosis substance abuse and failed to properly evaluate and treat Daniel Kuc's drug withdrawal.

The plaintiffs request a trial by jury and seek actual and punitive damages, attorney's fees, costs and all other relief as the court deems proper and just. They are represented by Timothy Roldan of Law Offices of Timothy Roldan in Clayton and Joseph A. Ott of Ott Law Firm in St. Louis.
