Sister, father file wrongful death suit against Barnes-Jewish Hospital over man's death

ST. LOUIS – The sister and father of a man who died as a result of injuries from falling in his hospital room are seeking damages from nurses and the medical facilities.

Victoria Anderson, as plaintiff ad litem personal representative of William Hawkins Jr., and William Hawkins Sr. filed a complaint on Sept. 6 in the St. Louis 22nd Judicial Circuit Court against Sara Robards, The Washington University, Barnes-Jewish Hospital, et al. alleging wrongful death and other counts.

According to the complaint, the plaintiffs allege that between Sept. 5 and Oct. 28, 2016, the defendants provided cancer care and treatment to plaintiffs' decedent William Hawkins Jr. The suit states on Oct. 3, 2016, William Hawkins Jr. fell while in his hospital room and again the next day, resulting in a massive brain hemorrhage and coma. The suit states he died Oct. 28, 2016.

The plaintiffs hold the defendants responsible because the defendants allegedly failed to take all steps consistent with their protocols and procedures for fall-risk patients and failed to implement safety measures.

The plaintiffs seek damages against the defendants, jointly and severally, in an amount that is fair and reasonable, plus costs and any further relief as the court may deem proper and just. They are represented by Kirk J. Wittner of STL Law Group LLC in St. Louis.
