Suit filed against Rexall, Corporate Mailing over faxes

ST. LOUIS – A Missouri company and an Alabama resident allege corporations in New York and New Jersey sent it advertisement faxes without their consent.

Radha Geismann, MD PC and John H. Lary Jr., MD, individually and on behalf of all others similarly situated, filed a complaint on Sept. 4 in the St. Louis Circuit Court against Rexall Inc. and Corporate Mailing Inc., doing business as CCG Marketing Solutions, alleging that they violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiffs allege that in March 5, 2013, the plaintiffs received unsolicited faxes from the defendants offering their goods, products and services. The plaintiffs allege the defendants did not have their consent to send the faxes.

The plaintiffs hold Rexall Inc. and Corporate Mailing Inc. responsible because the defendants allegedly sent facsimile advertisements to them and to more 39 other recipients without an opt-out notice as required by the TCPA or consent.

The plaintiffs seek an order declaring this case as a class action, and appointing plaintiffs and their counsel as representatives, award fort damages of $500 for each violation of the Act and all other relief that are proper and just. They are represented by Mark G. Margulis of Margulis Law Group in Chesterfield and Brian J. James of Anderson + Wanca in Rolling Meadows, Illinois.
