Paralyzed Moped driver alleges St. Louis failed to give adequate notice of lane closure

ST. LOUIS – A man alleges he was permanently paralyzed after an accident while operating his Moped in St. Louis.

Dale Horton filed a complaint on Sept. 13 in the St. Louis Circuit Court against the city of St. Louis alleging dangerous condition of a roadway.

According to the complaint, the plaintiff alleges that on May 21, he was operating a Moped on River Des Peres Boulevard and the defendant had closed one lane. The suit states the defendant had placed cones, a concrete barrier and signage but the plaintiff alleges there was inadequate notice of the lane closure.

The plaintiff alleges because of the unsafe lane closure, he was collided with and impacted. He alleges he sustained severe and permanent injuries to his head, neck, back and body as a whole as a result. He alleges he is permanently paralyzed and has lost the use of his lower extremities.

The plaintiff holds the city of St. Louis responsible because the defendant allegedly improperly barricaded the lane and failed to properly warn of the barricaded lane.

The plaintiff requests a trial by jury and seeks damages of more than $25,000, plus costs and all further relief as the court may deem just and proper. He is represented by Daniel J. Gauthier and Robert Pedroli Jr. of Pedroli & Gauthier LLC in Clayton.
