Representative seeks damages from Express Medical Transporters, driver over decedent's injuries from collision

ST. LOUIS – An estate representative is seeking damages from a driver and a medical transport company after her decedent was injured in a collision at a St. Louis intersection.

Maria Elena Tafolla Gomez, as personal representative of the estate of Maria Juana Gomez De Tafolla, filed a complaint on Sept. 12 in the St. Louis Circuit Court against Joseph Zempel and Express Medical Transporters Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on June 17, 2015, plaintiff's decedent De Tafolla was a passenger in a medical transport van owned by Express Medical Transporters when it was struck by another vehicle driven by Zempel in St. Louis. The suit states De Tafolla sustained severe injuries to her head, neck and back, and she died Aug. 1, 2017. 

The plaintiff holds Zempel and Express Medical Transporters Inc. responsible because defendant Zempel failed to stop at a traffic sign and failed to yield and Express Medical Transporters allegedly failed to appropriately and properly secure the defendant within the vehicle.

The plaintiff seeks judgment against each defendant in an amount of more than $25,000, plus costs and all further relief as the court may deem proper and just. She is represented by Gonzalo Fernandez of Devereaux, Stokes, Fernandez & Leonard PC in St. Louis.
