ST. LOUIS – A man alleges he was exposed to asbestos in Tennessee and Texas and that the exposure caused him to develop lung cancer.
Billy Godfrey filed a complaint on Sept. 11 in the St. Louis 22nd Judicial Circuit Court against Anco Insulations Inc., Carrier Corp., Chevron Phillips Chemical Co., et al. alleging negligence and other counts.
According to the complaint, the plaintiff alleges that at various times during his work beginning in the 1950s, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. The suit states that on or about Aug. 30, 2017, he was diagnosed with lung cancer, an asbestos-induced disease, and subsequently learned that the disease was wrongfully caused.
The plaintiff holds Anco Insulations Inc., Carrier Corp., Chevron Phillips Chemical Co., et al. responsible because the defendant allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
The plaintiff requests a trial by jury and seeks compensatory of more than $50,000, plus costs, interest and all further relief as the court may deem just and equitable. He is represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
