Man alleges lung cancer caused by asbestos exposure in North Dakota, Minnesota

ST. LOUIS – A man alleges he developed lung cancer as a result of exposure to asbestos from 1961 to the early 1970s during his employment.

Oscar Oppegard filed a complaint on Sept. 12 in the St. Louis 22nd Judicial Circuit Court against Agco Corp., Deere & Co., ITT Corp., et al. alleging negligence and other counts.

According to the complaint, the plaintiff alleges that at various times during his career life at locations in North Dakota and Minnesota, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants. The suit states that on or about Jan. 9, he first became aware that he developed lung cancer, an asbestos-induced disease, and subsequently learned that it was wrongfully caused.

The plaintiff holds Agco Corp., Deere & Co., ITT Corp., et al. responsible because the defendants allegedly intentionally included asbestos fibers in their products when they knew that it had toxic, poisonous and highly deleterious effect to human health and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks compensatory damages of no less than $50,000, plus interest, costs and any further relief as the court deems just and equitable. He is represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
