Negligence suit filed against Royal Oak Nursing and Rehab over resident's death

ST. LOUIS – A mother has filed a suit against several health care entities over the 2016 death of her son.

Earnestine Brooks, individually and as member and representative of the statutory wrongful death class as set forth in RSMo. Section 537.080, filed a complaint on Sept. 14 in the St. Louis Circuit Court against Royal Oak Nursing and Rehab LLC, et al. alleging negligence and other counts.

According to the complaint, the plaintiff alleges that on Sept. 15, 2016, her son, Antonio Perkins, was a resident at defendant Royal Oaks' facility. The plaintiff alleges as a result of the defendants' negligence, the decedent was caused to suffer sympathetic storming and uncontrolled episodes until his death on Sept. 18, 2016. 

The plaintiff holds Royal Oak Nursing and Rehab LLC, et al. responsible because the defendants allegedly failed to assess and monitor decedent's condition and failed to prepare an appropriate care plan for decedent's medical condition.

The plaintiff requests a trial by jury and seeks damages in a fair and reasonable amount of more than $25,000, plus costs and all other relief deemed just and equitable. She is represented by Kyle Kleefus of Law Offices of Derald L. Gab PC in St. Louis.
