Navy veteran alleges asbestos exposure during military career led to lung cancer

ST. LOUIS – A veteran alleges he was exposed to asbestos while serving in the U.S. Navy and now has been diagnosed with lung cancer.

Ernest Floor and Kathleen Floor filed a complaint on Oct. 9 in the St. Louis 22nd Judicial Circuit Court against A.O. Smith Corp., Carver Pump Co., Flowserve Corp., et al. alleging negligence and other counts.

According to the complaint, the plaintiffs allege that various times during his career in the U.S. Navy from 1950 to 1974, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. He alleges that on or about May 31, he was diagnosed with lung cancer.

The plaintiffs hold A.O. Smith Corp., Carver Pump Co., Flowserve Corp., et al. responsible because the defendants allegedly intentionally included asbestos fibers in their products when they knew that it had toxic, poisonous and highly deleterious effect to human health and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiffs seek compensatory damages or more than $50,000, plus costs, interest and all further relief as the court may deem just and proper. They are represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
