St. Louis driver alleges rental car driver caused collision by improperly passing in bike lane/shoulder

ST. LOUIS – A St. Louis man is seeking damages from the driver of a rental car who attempted to go through an intersection on a red light by using the bike lane/shoulder before causing a collision.

John Samuel III filed a complaint on Oct. 24 in the St. Louis Circuit Court against John Doe and Robin Garth alleging negligence

According to the complaint, the plaintiff alleges that on April 15, 2017, he was driving his vehicle along Arlington Avenue approaching its intersection with Martin Luther King Drive in St. Louis with a green light. At the same time, Doe, who was driving a vehicle rented by Garth, used the right bike lane/shoulder of Martin Luther King Drive in an attempt to get through the intersection on a red light and stopped the vehicle in the intersection when he saw the plaintiff's car. The suit states the plaintiff struck the right side of the rental car.

The plaintiff alleges he sustained painful and disabling injuries to his head, neck, back, shoulders, right knee and right ring finger as a result of the collision. 

The plaintiff holds John Doe and Garth responsible because defendant Doe violated the electric signal, improperly passed in the bike lane/right shoulder and was distracted or inattentive to traffic around him.

The plaintiff seeks damages of no less than $25,000, interest, costs and all further relief as the court may deem jusy and proper. He is represented by Nathan A. Steimel of Shea Kohl Law LC in St. Charles.
