Ascension Mobile seeks fees from tenant's guarantor

ST. LOUIS – The landlord of a St. Louis property alleges it was not paid certain fees from its tenant and is seeking payment from the tenant's guarantor.

Ascension Mobile LLC filed a complaint on Oct. 24 in the St. Louis Circuit Court against Christopher Reynhout alleging breach of guaranty

According to the complaint, on Jan. 15, 2016, plaintiff entered into a lease agreement with C.A.R. Pharmacy whereby C.A.R. leased plaintiff's certain real property and improvements in St. Louis.  The suit states the defendant personally guaranteed C.A.R.'s performance. 

The suit states in December 2017, C.A.R. filed a lawsuit against the plaintiff and the plaintiff filed counterclaims. The plaintiff alleges it incurred attorney's fees as a result of this filing and included this amount in the July and August invoices.

The plaintiff alleges C.A.R. did not make a payment toward these fees and it is entitled to collect them from the defendant.

The plaintiff seeks damages of more than $25,000, attorney's fees, costs, interest and any further relief as the court may deem proper and just. It is represented by Theodore D. Dearing and Daniel T. Batten of Dearing & Hartzog LC in Clayton.
