Welder seeks damages from BNSF Railway over alleged back injury

ST. LOUIS – A Seymour man alleges he injured his back while working for a railroad company as a welder.

Jason Kingery filed a complaint on Oct. 30 in the St. Louis Circuit Court against BNSF Railway Co. citing the Federal Employers' Liability Act.

According to the complaint, the plaintiff worked for the defendant as a welder and developed a back condition that first manifested in January 2009.

The plaintiff holds BNSF Railway Co. responsible because the defendant allegedly failed to provide a safe place to work and provide adequate manpower, adequate training and supervision.

The suit states the plaintiff previously filed a suit against the defendant in 2011 in Montana and the case was dismissed in October 2018.

The plaintiff requests a trial by jury and seeks damages of no less than $25,000 together with costs of this action. He is represented by Steven L. Groves of Groves Powers LLC in St. Louis.
