Passenger injured in I-57 collision seeks damages from Alfa Specialty Insurance, driver

ST. LOUIS – A woman injured in a collision on Interstate 57 is seeking damages from the driver and her insurance company.

Ruby Jean Townsend filed a complaint on Nov. 6 in the St. Louis Circuit Court against Marcus Devel Emanuel and Alfa Specialty Insurance Corp. alleging breach of contract and personal injuries.

According to the complaint, on Nov. 15, 2013, the plaintiff was a passenger in the vehicle driven by defendant Emanuel when they were involved in an accident on Interstate 57 in Mississippi County allegedly due to Emanuel's negligence. She alleges she sustained severe and permanent injuries, including but not limited to multiple fractures, chest contusions, bruise on the head and subconjunctival hemorrhage as a result of the collision.

The suit states the plaintiff had a policy of insurance through Alfa at the time of the accident but it states the negligent party was not a covered driver under her policy. She alleges she made a demand for payment under the policy but Alfa has refused to pay.

The plaintiff holds Emanuel and Alfa Specialty Insurance Corp. responsible because defendant Emanuel failed to maintain careful a lookout and was inattentive and Alfa's alleged conduct is without reasonable cause or excuse.

The plaintiff requests a trial by jury and seeks actual damages, costs, interest and all further relief as the court may deem proper and just. She is represented by S. Lee Patton of Lee Patton, Attorney at Law in Kirkwood.
