CBS, Union Carbide named in asbestos injury suit by couple over cancer diagnosis

ST. LOUIS – A couple is seeking damages from several companies over allegations the husband's exposure to asbestos beginning in 1965 led to the development of lung cancer.

Gary Bush and Richele Bush filed a complaint on Nov. 8 in the St. Louis 22nd Judicial Circuit Court against CBS Corp., Union Carbide Corp., et al. alleging strict liability and other counts.

According to the complaint, Gary Bush alleges from 1965 to 1966 and then from 1969 to 1972, he was first exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants while working as an HVAC laborer in Michigan. The suit states that on or about Dec. 15, 2017, he first became aware that he developed lung cancer, an asbestos-induced disease.

The plaintiffs hold CBS Corp., Union Carbide Corp., et al. responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiffs seek actual and compensatory damages of more than $50,000, plus interest, costs and all further relief that the court may deem proper and just. They are represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
