Motorist alleges America Family Mutual Insurance failed to pay amounts due under policy

ST. LOUIS – A St. Louis motorist alleges her insurance company has refused to pay her amounts due under a policy over damages she sustained in an auto accident.

Christine Foerstel filed a complaint on Dec. 21 in the St. Louis Circuit Court against America Family Mutual Insurance Co. alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that on April 15, 2013, she was exiting Highway 55 towards Highway 141 when an underinsured driver rear-ended her vehicle. She alleges she sustained injuries resulting in pain and suffering, medical bills and lost wages. 

She alleges she had a policy of insurance with the defendant and is entitled to receive any and all proceeds due under the terms of the policy.

The plaintiff holds America Family Mutual Insurance Co. responsible because the defendant allegedly failed and refused to pay the amounts due under the terms of the policy.

The plaintiff seeks damages in the amount of $100,000, attorney's fees, costs and all further relief as the court may deem just and proper. She is represented by Patrick Hinrichs of The Bradley Law Firm in St. Louis.
