Injured motorist alleges Farmers Insurance refused demand for payment of policy limits

ST. LOUIS – A Warren County motorist alleges her insurer had no reasonable cause or excuse to refuse to pay her the amounts she alleges she is owed under her policy.

Rebecca Chemin filed a complaint on Dec. 27 in the St. Louis Circuit Court against Farmers Insurance Co. Inc. alleging vexatious refusal and breach of underinsured motorist policy.

According to the complaint, the plaintiff alleges that on July 11, 2016, she was injured in a motor vehicle accident in Lincoln County due to the carelessness of an underinsured motorist. The plaintiff alleges she sustained damages in excess of the tortfeasor's policy limits.

The plaintiff alleges in June 2018, the defendant rejected her demand for payment of the limits of her underinsured motorist policy and refused to pay her more than $176,733. She alleges she suffered damages of more than $1.1 million.

The plaintiff seeks damages of more than $1 million, plus interest, attorney's fees, costs and any further relief as the court may deem just and proper. She is represented by Todd R. Nissenholtz of Cofman Townsley LLP in St. Louis.
