BNSF Railway engineer alleges vest's failure to break away caused fall

ST. LOUIS – A locomotive engineer alleges he sustained injuries to his spine while working in a St. Louis rail yard in a fall.

Douglas Overfield filed a complaint on Jan. 9 in the St. Louis Circuit Court against BNSF Railway Co. citing the Federal Employers' Liability Act.

According to the complaint, the plaintiff alleges that on March 18, 2018, he was working within the course and scope of his employment with the defendant in Lindenwood Yard in St. Louis when his safety vest caught on a rear door handle mechanism and did not break free, causing him to fall. He alleges he sustained injuries to his spine and was caused to suffer pain, emotional distress, medical expenses and lost wages. 

The plaintiff holds BNSF Railway Co. responsible because the defendant allegedly failed to provide a reasonably safe place to work and failed to provide safe and suitable equipment.

The plaintiff requests a trial by jury and seeks damages of more than $25,000, pus costs. He is represented by Nelson G. Wolff and Celia K. Douglas of Schlichter Bogard and Denton LLP in St. Louis.
