City of Pevely sued by Super 8 Motel owner for property closure

ST. LOUIS - Pevely Hospitality Group, LLC d/b/a Super 8 Motel and Sermad Amir filed a federal lawsuit on Dec. 7 in the Eastern District Court of Missouri against the City of Pevely.

According to the lawsuit, Pevely Hospitality Group, LLC (PHG) purchased the Super 8 Motel property in March 2018 that Amir operated and managed since its opening pursuant to a franchise agreement. On Nov.18, 2021, a city administrator, Andy Hixon, hand-delivered a letter notifying of the City's intent to close down the Super 8 Motel effective on Dec. 3, 2021. 

Amir requested documentation from City showing on what basis the property was to be closed down but was never furnished with such request materials, the suit claims. The City began performing various inspections of the property in early 2021 and demanded Amir make repairs, which was completed by PHG for a total exceeding $300,000, to prevent closing of the property, the suit says. The City claims the demands were not met, while also citing numerous calls for police to the property as part of the reasoning for closure. Amir claims adding the police calls is false and misleading and the City purposefully targets the Super 8 Motel for police patrols.
