Lawsuit says Home Depot forklift operator crushed customer in his truck

ST. LOUIS - Nicholas and Jessica Edison filed a lawsuit on Nov. 6 in St. Charles County Circuit Court against Home Depot, USA, Inc. for negligent training and negligence.

According to the lawsuit, on April 20, 2020, Plaintiffs were at the Home Depot in Wentzville and had picked out landscaping bricks that were to be loaded into their vehicle via a forklift driven by Home Depot employee, referred to as John Doe. 

While attempting to load the materials without a spotter, Doe crushed the camper shell on the bed of the truck, the suit says. Nicholas Edison told Doe to hold on a moment and got into the bed of the truck and was attempting to move something as John Doe then crushed him with the forklift and pinned him against the truck bed, the suit says. 

Nicholas reported the incident and injuries to Home Depot. During another visit, Jessica Edison was almost struck by the same forklift and operator while walking down the aisle, the suit says.

The Edisons were caused to suffer personal injury, loss of consortium, severe and debilitating injuries including a crush injury to Nicholas' chest wall, lost wages, loss of enjoyment of life and pain and suffering. 

The Edisons seek a judgment in favor for their costs. The Edisons are represented by Megen I. Hoffman of Law Offices of Rick Barry, P.C.

Home Depot recently removed the case to St. Louis federal court.
