Former employee files ADA lawsuit against Proofpoint

A man says his former employer violated the Americans with Disabilities Act.

Marc Heflin filed his lawsuit in federal court against Proofpoint Inc.

Heflin says he requested reasonable accommodations for his Irritable Bowel Syndrome between February 2020 and April 2022 and again in November 2022. He says Proofpoint failed to provide those reasonable accommodations.

The complaint includes several counts detailing instances where Proofpoint allegedly failed to accommodate Heflin's disabilities and subjected him to disparate treatment. Additionally, it claims the company did not accommodate Heflin’s disabilities by transferring him to any one of the alternative more accommodating open positions he applied for and was qualified for at Proofpoint.

Furthermore, Heflin says he was subjected to disparate treatment for having engaged in protected conduct pursuant to the ADA in seeking ADA-related accommodations. This included actively interfering with one or more job applications he submitted for alternative positions within Proofpoint and demanding Heflin withdraw his application for an alternate, more accommodating job at Proofpoint.

Finally, the complaint alleges retaliation against Heflin for filing charges of discrimination with the Equal Employment Opportunity Commission in February 2020. 

Heflin seeks compensatory damages.
