A Texas-based food company says packaging company failed to deliver on its promise of providing a requested system.
John Soules Foods Inc filed its lawsuit in federal court against Multivac Inc.
The plaintiff claims Multivac failed to deliver on its promise of providing a packaging system capable of processing 14,000 pounds of product per hour for JSF's new tray-style packaging design.
In early 2020, JSF says it decided to expand its offerings beyond traditional plastic bag packaging. The company sought to introduce a semi-rigid formed horizontal package which would improve shelf presentation and automate its packaging line. The new system was planned for installation at JSF's facility in Valley, Alabama.
Multivac, having worked with JSF previously, expressed interest and capability in creating the required system. After several months of design and engineering work involving extensive discussions and third-party suppliers, Multivac proposed a solution involving three of its RX 4.0 packaging machines and three H244 robotic channeling machines.
The defendant assured JSF that the machines would meet their specific requirements including operation speeds of at least 11 cycles per minute and operational "up time" rates of 96-98%. However, according to the complaint filed on January 29th, 2024, Multivac failed to deliver on these promises leading to the current legal action.
JSF seeks compensatory damages and other relief.
