Parents seek partial reversal of state special education decision for son

The parents of a special education student say the school system failed to provide the boy with free appropriate public education.

Shannon Hayslett and Christopher Lloyd have filed their lawsuit in federal court against the Special School District of St. Louis County and Ferguson-Florissant School District seeking a partial reversal of a special education decision made by the Missouri Administrative Hearing Commission.

The superintendents named in the lawsuit are Dr. Joseph Davis of FFSD and Dr. Michael Maclin of SSD. Both school districts are located in St. Louis County.

The case revolves around their 9-year-old son identified only as A.L., who has an educational diagnosis of Language Impairment, Sound System Disorder, and Specific Learning Disabilities in Basic Reading, Reading Fluency and Written Expression.

The parents argue that the school districts failed to provide A.L. with free appropriate public education (FAPE) as required by the Individuals with Disabilities Act. They also claim the districts did not adhere to IDEA's child find mandate which requires school districts to identify, locate and evaluate all children with disabilities who need special education and related services.

According to the complaint, the plaintiffs previously had filed a Due Process Petition before the Missouri Administrative Hearing Commission.
