Carjacking, lost AirPods result in federal lawsuit

A federal lawsuit has been filed against St. Louis County and Detective Joseph Percich, accusing them of civil rights violations and a state law Sunshine Act violation. 

The plaintiffs, Lindell Briscoe and Brittany Arlesia Shamily, allege Detective Percich used an Apple application called "FindMy" to locate lost AirPods which were found near their home in North County following a carjacking incident in South County.

The lawsuit claims the detective concluded unconstitutionally that the plaintiffs were involved in the carjacking based on the location of the AirPods. It further alleges Percich made misstatements and material omissions in his search warrant application leading to an unjustified SWAT Team Raid on the plaintiffs' house.

The plaintiffs are demanding a jury trial for damages over force and detention, use of SWAT without constitutional justification, Monell liability, and for a state law Sunshine Act violation.

They are being represented by W. Bevis Schock and Erich Vieth.
