ST. LOUIS — Trustee representatives are suing Cornerstone Masonry Inc. for alleged violation of workers compensation acts.

Greater St. Louis Construction Laborers Welfare Fund, Construction Laborers Pension Trust of Greater St. Louis, Eastern Missouri Laborers Joint Training Fund, et al filed a complaint on April 10 in the U.S. District Court for the Eastern District of Missouri against the defendant alleging that it violated the Employee Retirement Income Security Act (ERISA).

According to the complaint, the plaintiffs allege that between April 1, 2015, and June 30, 2016, they performed a financial examination and discovered that they failed to receive $52,741.27 in contributions for that period of time. They failed to receive accurate amount and submission of monthly report forms as required by the provisions of the collective bargaining agreements. 

The plaintiffs holds Cornerstone Masonry responsible because the defendant allegedly failed to update monthly reports for the contributions, failed to pay trustees accurate amount and failed to establish and maintain a surety bond as required by the collective bargaining agreement.

The plaintiffs seek all payments for financial examination, liquidated damages, 2016 contributions and further relief as the court deems appropriate under the circumstances. They are represented by Janine M. Martin of Hammond and Shinners PC in St. Louis.
