Roeslein claims former employee stole trade secrets, providing them to competitor

ST. LOUIS — Energy production facilities are suing Thomas Elgin, Elgin Meyer Bioenergy Co. and J.S. Meyer Engineering PC, citing alleged breach of contract by using trade secret information resulting in unfair competition.

Roeslein & Associates Inc. and Roeslein Alternative Energy LLC filed a complaint on April 18 in the U.S. District Court for the Eastern District of Missouri against the defendants alleging that they violated the Federal Defend Trade Secrets Act and The Missouri Uniform Trade Secret Act.

According to the complaint, the plaintiffs allege that on June 12, 2015, after terminating Elgin, who started working for J.S. Meyer, the plaintiff learned that its trade secret information and confidential documents, all of which are regarded as intellectual property with U.S. patents were stolen, improperly used and provided to J.S. Meyer. All of these are still in the bounds employment agreement that Elgin signed during employment with plaintiff, the complaint states. 

The plaintiffs allege that Elgin failed to comply with his signed contract under the employment agreement or confidentiality agreement. The defendants also failed to comply with the U.S. Patent by continuing to reveal, provide, disclose and use plaintiff's trade secret information in the development of new products.

The plaintiffs request a trial by jury and seek preliminary and permanent injunction to stop using its intellectual properties, all damages incurred, costs, pre- and post-judgment interest and all other relief to which the plaintiff may be entitled. They are represented by Steven M. Sherman, Michael L. Nepple and Aaron W. Banks of Thompson Coburn LLP in St. Louis.
