Parents of deceased child accuse Hardee's, CKE Restaurant Holdings Inc. of failing to maintain safe play area

ST. LOUIS — The parents of a deceased child are suing CKE Restaurant Holdings Inc., Hardee's and others for allegedly  failure to maintain its play area that resulted to fatal injuries.

The estate of I.E. Hersh, Ahmad Hersh, Muna Omer filed a complaint on July 20 in the U.S. District Court for the Eastern District of Missouri Eastern Division, alleging that the defendants failed to use reasonable care to ensure that the play structure was safe for children to play on.

According to the complaint, the plaintiffs allege that while at the defendants' restaurant, the plaintiffs allowed their son to play in the play area of the premises on July 20, 2015. While playing, the child allegedly climbed out of the and on top of the slide, where he touched a metal object that resulted in an electrical shock, which immediately killing him

The plaintiffs hold the defendants responsible for failing to properly inspect and make sure that the play area was properly maintained and warn or advise patrons that the play structure may be dangerous for children.

The plaintiffs request a trial by jury and seek to award of no less than $30 million for compensatory and punitive damages plus costs, attorney's fees and any other relief deemed just. They are represented by Mohamed J. Zaher of Advanta Law PLC in Southfield.
