Progressive Insurance accused of breach of contract

ST. LOUIS — A vehicle passenger is suing an insurance company, citing alleged breach of contract.

Charsetta Palmer-Smith filed a complaint on Nov. 8 in the St. Louis 22nd Judicial Circuit Court against Progressive Insurance alleging that the defendant breached its insurance policy contract by refusing to provide uninsured motorist coverage.

According to the complaint, Palmer-Smith alleges that on June 30, 2016 she was passenger in a 2006 Mitsubishi vehicle driven by an insured client of the defendant when the vehicle was rear-ended by an unknown motorist at Halls Ferry Road. Palmer claims she suffered medical expenses totaling approximately $1,700 and has made claim for benefits under the uninsured motorist coverage of the defendant's policy. 

The plaintiff holds Progressive Insurance responsible because the defendant allegedly failed to compensate for damages incurred, and refused to make payment due and owing.

The plaintiff requests a trial by jury, and seeks judgment in an amount that is fair and reasonable in excess of $25,000 but less than $75,000 for costs, interest, and for such other and further relief as the court deems just and proper.
