Former Subway/Wing Stop worker alleges breach of contract

ST. LOUIS — A Subway and Wing Stop employee, who was accused of assaulting one of her supervisors, is suing citing alleged breach of contract and false imprisonment.

Samiya Wright filed a complaint on Nov. 9 in the St. Louis 22nd Judicial Circuit Court against Roya Moshiri and Healthy Meal Creations Inc. alleging that they breached an employment contract by refusing to pay for both overtime and regular work hours, and also had the plaintiff falsely imprisoned under malicious prosecution.

According to the complaint, the plaintiff alleges that between May 2013 and August 2015, while working for the  defendants at a Subway and Wing Stop store, she was deprived of her wages, earnings tax and overtime compensation. She also claims she was wrongfully accused of assaulting Moshiri and stealing, and was arrested by the St. Louis Police Department against her will. 

As a result, Wright claims she suffered lost wages, criminal prosecution and mental anguish. 

The plaintiff holds the defendants responsible for alleged alteration and falsifying of wage hour records of an employee, and false reporting with the malicious intent to make the employee suffer and subject to criminal prosecution.

The plaintiff requests a trial by jury; and seeks judgment for consequential and punitive damages, and all other further relief that the court deems just and proper. She is represented by Richard A. Voytas, Nathan E. Ross and Ethan W. Gee of Ross & Voytas LLC in St. Louis.
