Driver and passenger claim motorist failed to stop at traffic sign

ST. LOUIS — A driver and passenger are suing another motorist, claiming his negligence caused a collision.

Andrew Lindsey and Lavinia Davis filed a complaint on Nov. 7 in the St. Louis 22nd Judicial Circuit Court against Darwin Topps alleging that the defendant operated his vehicle so as to caused collision that resulted in  injuries to others.

According to the complaint, the plaintiffs allege that on July 20 Lindsey was driving with Davis on Magnolia Avenue when their vehicle was struck by Topps' vehicle. As a result, Lindsey and Davis claim they sustained physical injuries. 

The plaintiffs hold Topps responsible because he allegedly failed to keep a careful lookout, violated a traffic sign and failed to yield the right of way.

The plaintiffs request a trial by jury; and seek judgment for a fair and reasonable amount in excess of $25,000 for costs expended, and for such other and further relief as the court deems just and proper under the circumstances.
