ST. LOUIS — A worker is suing a number of real estate contractors, citing alleged negligence following a stairwell collapse.
Joseph Pfaff filed a complaint on Nov. 8 in the St. Louis Circuit Court against HSAD Inc., James P. Hepfner, John W, Airhart and others, alleging that they failed to exercise the degree of care and skill commonly exercised by a careful and prudent contractor under the same or similar circumstances.
According to the complaint, the plaintiff alleges that on Nov. 11, 2012 he was working inside the stairwell at the Lindell Apartments when it collapsed upon him. He sustained severe injuries to his head, neck, back, arms and wrist. The plaintiff holds the defendants responsible because they allegedly failed to construct the stairwell according to the plans and specifications, and failed to provide adequate warnings of the hidden defect of the stairwell.
The plaintiff requests a trial by jury; and seeks damages of more than $25,000, plus costs of this action and any further relief as the court deems just and proper. He is represented by James D. O' Leary and James T. Corrigan of O'Leary, Shelton, Corrigan, Peterson, Dalton & Quillin LLC in St. Louis.
