ST. LOUIS — A driver is suing after allegedly being struck by another vehicle operator while proceeding through a St. Louis intersection on a green light signal.
Bajes N. Dugom filed a complaint on Nov. 8 in the St. Louis 22nd Judicial Circuit Court against Montrell Duff and Planet Rent to Own LLC, alleging that the defendants failed their duty to exercise the highest degree of care in the operation and maintenance of the motor vehicle.
According to the complaint, the plaintiff alleges that on Aug. 19, he was driving north on North Grand Boulevard when he was struck in the middle of the intersection on a green light traffic signal. The plaintiff claims he was blind-sided by a vehicle driven by Duff, who had rented the car from Planet Rent to Own.
As a result, Dugom claims he lost consciousness during the crash and sustained serious personal injuries.
The plaintiff holds Duff responsible because he allegedly made an improper lefthand turn, failed to maintain control of his vehicle, failed to keep a careful lookout and failed to attend to the roadway. Planet Rent to Own allegedly allowed Duff to rent the vehicle without investigating his driving and criminal records beforehand.
The plaintiff requests a trial by jury and seeks judgment in a sum in excess of $25,000 for punitive damages, costs incurred, and for such further relief as may be just and proper. He is represented by John G. Simon and John M. Simon of The Simon Law Firm, PC in St. Louis.
