Progressive allegedly failed to pay policyholder

ST. LOUIS — An insurance policyholder is suing Progressive Casualty Insurance Company, citing alleged breach of contract.

Mildred Wigfall filed a complaint on Nov. 20 in the St. Louis Circuit Court against Progressive alleging that the licensed insurer failed to perform its contractual obligations.

According to the complaint, the plaintiff alleges that on March 15, 2014 she was hit by a car that was underinsured while her own insurance policy issued by the defendant was in full effect. She allegedly sustained injuries to her back, hips and shoulder; and incurred medical and other healthcare-related expenses. 

The plaintiff holds Progressive responsible because the defendant allegedly refused to pay her benefits under the underinsured motorist provisions of her insurance policy.

The plaintiff requests a trial by jury; and seeks damages between $25,000 and $75,000, plus additional statutory damages, costs of this suit and any other relief that may be appropriate. She is represented by Brent E. Labovitz of Defeo & Kolker LLC in Clayton.
