Insurance companies accused of refusing to pay up

ST. LOUIS — A Massachusetts resident is suing Auto Club Family Insurance Company and Citizens Insurance Company of America, citing alleged refusal to apply payments following an accident in Missouri.

Mary Patricia Fasce filed a complaint on Nov. 15 in the St. Clair County Circuit Court against the defendants alleging that they failed to comply with terms of an insurance policy.

According to the complaint, the plaintiff alleges that on June 24, 2015, she was a passenger in a motor vehicle driven by Nancy Fasce on Interstate 44 when the vehicle was struck by a tractor trailer whose owner and driver cannot be identified. Nancy and Mary Fasce were covered under uninsured motorist coverage, and the suit claims they are entitled to receive compensation for physical injuries and property damages incurred. 

The plaintiff holds Auto Club Family Insurance Company and Citizens Insurance Company of America responsible because the defendants allegedly are liable to pay insurance coverage for injuries and damages sustained by the insured as required under Missouri law.

The plaintiff requests a trial by jury and seeks judgment for an amount in excess of $25,000 for costs expended, and for such other and further relief as the court deems just and proper. Fasce is represented by Robert H. Pedroli and Eric A. Ruttencutter of Pedroli & Gauthier in Clayton, Missouri.
