Landlord accused of negligence by guest who was injured in fall

Slip02

ST. LOUIS — A guest is suing a landlord, citing alleged negligence.

Etosha Russell filed a complaint on Nov. 28 in the St. Louis Circuit Court against Lucille Johnson alleging that she failed to exercise ordinary care to protect guests from foreseeable injury.

According to the complaint, the plaintiff alleges that on July 18, 2016, she was a guest at the defendant's premises at 4468 Bircher Blvd. in St. Louis City. While walking down the steps, she claims she slipped and fell on uneven and damaged stones. She allegedly sustained injuries to her tailbone, back and neck.

The plaintiff holds Johnson responsible because she allegedly failed to maintain the stairways in the rental property in a reasonably safe condition and failed to warn guests of the unsafe condition that existed on the premises.

The plaintiff requests a trial by jury; and seeks damages in an amount to be proven by jury, and for any further relief as the court deems just and proper. She is represented by Gary K. Burger of Burger Law LLC in St. Louis.
